These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Atticus Technology Software FZCO ("Atticus," "Studio," "we," "us," or "our"), a Free Zone Company established in March 2019 and registered with the International Free Zone Authority (IFZA) under License No. 87040, with its registered office at IFZA Business Park, Dubai Silicon Oasis, Dubai, United Arab Emirates.
Atticus is licensed under UAE activity codes 620200 (Computer Systems & Communication Equipment Software Design) and 620900(IT Infrastructure & Network Solutions Consultancies). These Terms govern your access to and use of all websites, products, applications, platforms, APIs, and professional services provided by Atticus (collectively, the "Services").
By accessing our website, engaging us for a project, signing a statement of work, creating an account, or using any Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Scope of Services
Atticus is a software studio that designs, builds, ships, and operates digital products for founders and teams. The Services offered under these Terms include, without limitation, the following six practice areas:
2.1 Mobile Applications
Native and cross-platform mobile applications for iOS and Android, including architecture, UI/UX, API integration, offline behavior, push notifications, App Store / Google Play submission, post-launch monitoring, and staged rollouts. Deliverables may include source code, build pipelines, release notes, and observability dashboards.
2.2 Web Platforms
Full-stack web platforms built on modern frameworks (Next.js, React, TypeScript, Node.js, Go, and related stacks), including marketing sites, dashboards, internal tools, multi-tenant SaaS platforms, real-time systems, and API backends. Hosting, CDN, performance budgets, and accessibility are considered part of delivery unless scoped out in writing.
2.3 Product Strategy & Consulting
Discovery engagements, product scoping, technical due diligence, architecture reviews, roadmap planning, and CTO-level advisory. Outputs are typically written artifacts (decision memos, scoping documents, architecture diagrams, cost models) and are delivered on fixed-fee or retainer terms.
2.4 Usage-Based Billing Systems
Metering, rating, invoicing, and payment-orchestration components for products that charge by consumption (per request, per minute, per seat, per event). Atticus can design and operate usage-based billing infrastructure either as part of a bespoke product build or as a stand-alone integration.
2.5 Custom & Bespoke Software
One-off automations, scripts, internal tools, integrations, data pipelines, and bespoke systems tailored to a specific operational problem. Work is delivered against a written statement of work and may be transferred in full to the Client upon final payment.
2.6 Security & Compliance
Application security reviews, dependency hardening, authentication and authorization design, secrets management, logging and audit trails, and preparatory work toward common compliance regimes (SOC 2 readiness, GDPR/UAE PDPL alignment, PCI-SAQ scoping). Atticus does not issue certifications; any attestation must be performed by an accredited third party.
3. Service Tiers & Indicative Pricing
For selected practice areas, Atticus publishes indicative starting tiers on its website. The published tiers are entry points for simple engagements; actual project pricing is confirmed in a written quote or statement of work issued before work begins. The currently published tiers are:
3.1 Mobile Applications
- Starter — 9 USD: A minimal mobile build targeting a single platform with a narrow feature set, suitable for validating a single user flow.
- Growth — 19 USD: A cross-platform build covering the core product journey, basic analytics, and an initial store submission.
- Scale — 29 USD: A production-grade mobile build with offline behavior, push notifications, observability, and a staged release pipeline.
3.2 Web Platforms
- Landing — 9 USD: A single-page marketing site with responsive design, forms, and analytics.
- Business — 19 USD: A multi-section marketing or brochure site including CMS wiring and basic SEO groundwork.
- Platform — 29 USD: A full web platform with authentication, authorization, a dashboard, and a backend API.
3.3 Custom & Bespoke Software
- Script — 9 USD: A targeted automation or one-shot script for a narrow task.
- Tool — 19 USD: An internal tool or integration covering a contained workflow.
- System — 29 USD: A multi-component bespoke system with persistent storage, scheduled jobs, and an operational runbook.
3.4 Security & Compliance
- Scan — 9 USD: A lightweight dependency and configuration scan with a written report of findings.
- Harden — 19 USD: Applied hardening of authentication, secrets, logging, and deployment configuration.
- Audit — 29 USD: A deeper application security review with prioritized remediation recommendations and a readiness assessment.
Each tier is an indicative starting price only. Scope, integrations, compliance obligations, platform fees (App Store, Google Play, payment processors), third-party licenses, and ongoing operation are priced separately. Clients requiring a tailored scope may request a custom quote at any time.
4. Engagement, Quotes & Statements of Work
No engagement is formed by visiting the website or by clicking a tier. A binding engagement is created only once: (a) Atticus issues a written quote or statement of work ("SOW"); (b) the Client accepts the SOW in writing (including by email); and (c) any required deposit is received. The SOW controls over any conflicting language on the website.
5. Payments & Virtual POS
Atticus accepts payments through bank transfer and, where enabled, through authorized virtual point-of-sale ("POS") providers. Clicking a published tier on the website currently routes you to email so that we can confirm scope before any payment is taken; once the virtual POS integration is live, selected tiers may be purchased directly through the POS provider.
- Visa or MasterCard debit and credit cards in AED will be accepted for payment. American Express may also be accepted where supported by our virtual POS partner.
- The displayed price and currency at the checkout page will be the same price and currency printed on the Transaction Receipt, and the amount charged to the card will be shown in your card currency.
- Card payments are processed by our authorized virtual POS partner. Atticus does not store full card numbers, CVVs, or equivalent card data on its own infrastructure; card data is handled directly by the POS provider subject to their terms and PCI-DSS obligations.
- Invoices are exclusive of VAT and any other applicable tax unless expressly stated.
- Invoices are due within fourteen (14) days of issuance unless a different term is stated on the invoice or in the SOW. Late amounts may accrue interest at the lower of 1.5% per month or the maximum permitted by UAE law.
- Usage-based charges, where applicable, are measured by our systems and invoiced at the end of each billing cycle as defined in the SOW. Disputes to a specific line item must be raised within thirty (30) days of the invoice date.
- Except where required by law or stated in the SOW, fees paid are non-refundable. Refund requests are handled under our Refund Policy.
5.1 Payment Confirmation
Once the payment is made, the confirmation notice will be sent to the client via email within 24 hours of receipt. The confirmation will include the transaction reference, the amount charged, the currency displayed at checkout, and the engagement or invoice it relates to. Where SMS is supported for your account, a short confirmation may also be sent in addition to the email.
5.2 Cardholder Records
The Cardholder must retain a copy of transaction records and https://atticussoftwaretech.com/ policies and rules. We recommend keeping the email confirmation, the on-screen receipt, and any signed SOW for your records.
5.3 Sanctions & Restricted Jurisdictions
We will not trade with or provide any services to OFAC and sanctioned countries. The Client confirms that it is not located in, and will not use the Services from, a jurisdiction subject to comprehensive UAE, UN, EU, UK or US sanctions, and that it is not on any applicable sanctions or restricted-party list.
6. Delivery, Acceptance & Change Requests
Deliverables are provided against milestones defined in the SOW. A milestone is considered accepted if the Client does not raise written objections within seven (7) days of delivery, or upon Client use of the deliverable in production, whichever occurs first. Changes to agreed scope are handled through written change requests and may affect fees and timeline.
7. Account Registration & Security
Certain Services require an account. By registering, you agree to provide accurate and current information, keep your credentials confidential, remain responsible for all activity under your account, and notify us promptly of any suspected unauthorized use. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
The User is responsible for maintaining the confidentiality of his account. Any actions taken through your account using your credentials are deemed to be taken by you, and Atticus is not liable for losses resulting from credentials shared, lost or compromised through your failure to safeguard them.
8. Acceptable Use
You agree not to, and not to permit any third party to:
- Use the Services in violation of applicable UAE law or the law of any other jurisdiction relevant to your use.
- Use the Services to build, host, or operate content that is illegal, defamatory, hateful, sexually exploitative, or infringes intellectual property or privacy rights.
- Probe, scan, or test the vulnerability of any system or network operated by Atticus or its partners without prior written permission.
- Interfere with or disrupt the Services, including by sending malware, automated abuse, or excessive traffic outside of agreed usage.
- Reverse engineer, decompile, or attempt to extract the source code of any proprietary component of the Services, except to the extent expressly permitted by law.
- Resell, sublicense, or white-label the Services without a separate written agreement.
9. Intellectual Property
All pre-existing intellectual property of Atticus — including its frameworks, libraries, internal tools, design system, and reusable code — remains the property of Atticus. For bespoke deliverables produced specifically under a SOW, upon full payment and unless the SOW states otherwise, Atticus assigns to the Client all rights in the project-specific source code and design files, while retaining a perpetual, worldwide license to reuse generic patterns, ideas, and know-how developed during the engagement.
You retain ownership of all content you submit to the Services. By submitting content, you grant Atticus a non-exclusive, worldwide, royalty-free license to host, process, and display that content solely to the extent necessary to deliver the Services.
"Atticus," the Atticus wordmark, and the studio's visual identity are trademarks of Atticus Technology Software FZCO. You may reference the Atticus name accurately but may not imply endorsement or partnership without written permission.
10. Third-Party Services
The Services may depend on or integrate with third-party products and providers (for example: Apple, Google, hosting providers, payment processors including the virtual POS partner, analytics tools, and open-source libraries). Your use of those third parties is governed by their own terms, and Atticus is not liable for their acts, omissions, outages, fee changes, or policy changes.
11. Confidentiality
Each party agrees to keep the other party's confidential information in confidence and to use it only for purposes of the engagement. Confidential information does not include information that is already public, independently developed, or lawfully received from a third party without a duty of confidence. Confidentiality obligations survive termination.
12. Data Protection
Atticus processes personal data in line with applicable UAE data protection law (including Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data) and, where relevant, the EU General Data Protection Regulation (GDPR). Details on what we collect and why are set out in our Privacy Policy and, for web usage, our Cookie Policy. By using the Services, you acknowledge those policies.
13. Service Availability & Modifications
Atticus aims to keep its own web properties and hosted components available, but does not guarantee uninterrupted access. We may change, suspend, or discontinue any Service, tier, or feature with reasonable notice, including where required by law or by a third-party provider. Scheduled maintenance and emergency patches may occur at any time.
14. Warranties & Disclaimers
Atticus warrants that it will perform the Services with reasonable skill and care and in line with industry standards. Except for this express warranty, the Services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, Atticus disclaims all other warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Atticus and its officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the Services, even if advised of the possibility of such damages.
Atticus's aggregate liability for all claims arising out of or related to the Services in any twelve (12) month period shall not exceed the fees actually paid by the Client to Atticus for the specific Service giving rise to the claim during that period.
16. Indemnification
You agree to indemnify, defend, and hold harmless Atticus and its officers, employees, contractors, and affiliates from any third-party claims, damages, losses, liabilities, and reasonable legal fees arising from (a) your use of the Services, (b) content you submit, (c) your breach of these Terms, or (d) your violation of any applicable law or third-party right.
17. Termination
Either party may terminate an engagement as set out in the SOW. Atticus may suspend or terminate access to the Services immediately if you breach these Terms, fail to pay invoiced amounts, or if continued provision would violate law or materially risk the Services or other clients. On termination, all outstanding fees become due, rights to use the Services cease, and each party returns or destroys the other's confidential information on request. Clauses that by their nature should survive (including payment, IP, confidentiality, liability, and governing law) will survive termination.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without reference to its conflict of laws rules. The parties will attempt in good faith to resolve any dispute within thirty (30) days of written notice. If not resolved, the dispute will be referred to the exclusive jurisdiction of the competent courts of Dubai, UAE, unless the parties have separately agreed in writing to arbitration under the DIFC-LCIA or DIAC rules.
19. Export, Sanctions & Compliance
You confirm that you are not located in, and will not use the Services from, a jurisdiction subject to comprehensive UAE, UN, EU, UK, or US sanctions, and that you are not on any applicable sanctions or restricted-party list. You will comply with all applicable export control laws.
20. Force Majeure
Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including acts of government, war, civil unrest, pandemic, natural disaster, internet or infrastructure outages, or failures of upstream providers. The affected party will use reasonable efforts to resume performance.
21. General Provisions
- Entire agreement. These Terms, together with any SOW, our Privacy Policy, Cookie Policy, and Refund Policy, form the entire agreement between the parties and supersede prior discussions.
- Order of precedence. If there is a conflict, a signed SOW prevails over these Terms, and these Terms prevail over any website copy.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
- Waiver. A failure or delay in enforcing a right is not a waiver of that right.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a corporate transaction.
- Notices. Notices to Atticus must be sent to info@atticussoftwaretech.com. Notices to you may be sent to the email address on your account or SOW.
- Independent contractors. The parties are independent contractors. These Terms create no partnership, agency, or employment relationship.
22. Changes to These Terms
Atticus may update these Terms from time to time. Material changes will be reflected in an updated "Last updated" date at the top of this page and, where appropriate, announced by email or on the website. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
